These Terms & Conditions ("Terms") govern your access to and use of the CaseKhabar mobile application and website (together, the "Service"), operated by CaseKhabar LLP ("CaseKhabar", "we", "us", "our"). By creating an account, ticking the acceptance box, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. About the Service

CaseKhabar is an information and notification tool. We help you monitor publicly available case, FIR and cause-list information published by Indian court portals (including, at present, the Allahabad High Court and eCourts portals), and we send you notifications (via WhatsApp, in-app and/or web) when we detect a change in the information we track for you.

The Service also provides: a "Court View" live cause-list/board view; tools to add private notes and to record amounts against your cases; and, for litigant users, an "Advocate Directory" that lists advocates who have registered with us.

We are a private information service. We are not affiliated with, endorsed by, or acting on behalf of any court, the eCourts project, the Government, any Bar Council, or any official body.

2. Eligibility

You must be at least 18 years old and competent to enter into a binding contract under the Indian Contract Act, 1872. You agree to use the Service only for lawful purposes and in compliance with all applicable laws.

3. Account Registration

To use the Service you must register with a valid WhatsApp number (mandatory) and verify it via a one-time password (OTP). You may optionally provide your name, email and a password.

You agree to provide accurate, current and complete information and to keep it updated. You are responsible for all activity under your account and for keeping your credentials and device secure. One person may maintain only one account. We may refuse, suspend or terminate accounts at our discretion.

4. Not Legal Advice; No Professional Relationship

CaseKhabar does not provide legal advice, legal opinions, or legal representation, and nothing on the Service constitutes such advice. Use of the Service does not create an advocate-client or any fiduciary relationship between you and us.

Always verify any information against the official court record and consult a qualified advocate before taking or refraining from any action.

AI-assisted drafts: Any document produced by our "Write an Application" or other AI-assisted drafting tools is an automatically generated draft for your consideration only. It may be inaccurate, incomplete, or unsuitable for your situation, does not constitute legal advice, and must be reviewed and edited by you (and, where appropriate, a qualified advocate) before any use, signing, or submission. You are solely responsible for the content you finalise, submit, or send.

5. Source Data, Accuracy and Alerts — Important Disclaimer

All case/FIR/cause-list information is sourced from third-party government and court websites through automated retrieval. That information is owned and controlled by those third parties, not by us.

Such data may be delayed, incomplete, outdated, inaccurate, reformatted, or temporarily or permanently unavailable for reasons outside our control — including website downtime, CAPTCHA or anti-bot measures, layout/format changes, network failures, or changes in how courts publish data.

• We do not guarantee the accuracy, completeness, timeliness, or availability of any information or alert.

• We do not guarantee that an alert will be generated, delivered, or delivered on time for any change, hearing date, listing, order, or event.

• You must not rely on the Service as your sole or primary means of tracking your case, hearing dates, limitation periods or deadlines.

To the maximum extent permitted by law, we are not liable for any missed, delayed, duplicated, or incorrect alert, or for any consequence arising from reliance on the Service, including missed hearings, missed deadlines, adverse orders, or any direct or indirect loss.

6. Notifications and Messaging

Notifications may be delivered through third-party messaging providers (for example, the WhatsApp Business Platform / Meta and/or other messaging APIs), push notifications, and the app/website. By registering, you consent to receive service and transactional messages from us at your registered WhatsApp number.

Delivery depends on those third parties, your network/carrier, your device settings, and WhatsApp policies, all of which are outside our control. Standard carrier/data charges may apply.

7. Plans, Fees and Payments

The Service may offer free and paid plans. Paid plans, where applicable, are billed through third-party payment processors (for example, Razorpay). Prices are inclusive or exclusive of applicable taxes as indicated at checkout.

Except where required by applicable law or expressly stated by us, fees are non-refundable. We may introduce, change or discontinue plans and pricing with reasonable notice. Your continued use after a change takes effect constitutes acceptance.

CK Wallet and CK coins: The Service offers a prepaid "CK Wallet" holding "CK coins" — a closed-loop store credit issued by us solely for use within the Service, where 1 CK coin equals INR 1. CK coins are purchased with real money through our payment processor (for example, Razorpay) and are used to pay for specific in-Service features (for example, generating an application, which costs a fixed number of CK coins that includes a single regeneration and saving the document as a PDF).

CK coins have no monetary value outside the Service. They are not money, a deposit, e-money, a prepaid payment instrument, or any regulated financial product. CK coins cannot be redeemed, refunded, exchanged, or withdrawn for cash, do not earn interest, and cannot be transferred to any other user, account, or third party.

CK coins are non-refundable. Unused CK coins are forfeited when your account is closed or terminated, except to the extent a refund is required by applicable law. We do not currently expire CK coins while your account remains active; if this changes, we will give reasonable notice. We may change the CK-coin price of any feature, or modify or discontinue the CK Wallet, on reasonable notice; on discontinuation we will deal with any unused balance in accordance with applicable law.

8. Acceptable Use

You agree not to: (a) use the Service for any unlawful, fraudulent, harassing, or abusive purpose; (b) copy, scrape, resell, or commercially exploit the Service or its data except as expressly permitted; (c) reverse engineer, interfere with, overload, or attempt to gain unauthorised access to the Service or its systems; (d) track cases or persons in violation of any law or any other person's rights; (e) misuse the Advocate Directory, including to spam, harass, or send unsolicited bulk communications; or (f) upload unlawful, infringing, or harmful content.

9. Advocate Directory and Contacting Advocates

The Advocate Directory lists advocates who have registered with us. We do not verify, endorse, recommend, or guarantee the identity, qualifications, competence, availability, fees, or conduct of any advocate, nor the outcome of any engagement.

Any communication, engagement, or transaction between a litigant and an advocate is solely between those users. We are not a party to it and are not responsible or liable for it. You are responsible for performing your own due diligence before engaging any advocate.

10. Additional Terms for Advocate Users

If you register as an advocate, the following also apply:

• Listing & display consent: You authorise us to publicly display, within the Service, the professional details you provide — including your name, High Court/bench, enrollment number and year, degree, place of practice, languages, areas of practice, courts, and your WhatsApp number — to other users (including litigants) for the purpose of being discovered and contacted.

• Accuracy & responsibility: You represent that your enrollment details are true and that you are entitled to practise. You are solely responsible for the accuracy of your profile and for all communications and dealings with users.

• Verification is best-effort: Any verification of enrollment we perform is automated and based on publicly available Bar/court rolls and is provided on a best-effort basis without warranty.

• Being contacted: You consent to being contacted by litigant users through the means provided in the Service. You may request removal of your listing at any time by contacting us.

• Compliance: You are responsible for ensuring that your listing and conduct comply with the Advocates Act, 1961, Bar Council of India rules (including rules on advertising/solicitation), and all applicable professional and legal norms. You agree to indemnify us against any claim arising from your listing or conduct.

11. Intellectual Property

The Service, including its software, design, branding, logos, and the name "CaseKhabar", is owned by us or our licensors and is protected by applicable laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. You retain ownership of content you create (such as notes and amounts), and grant us a licence to store and process it to provide the Service.

12. Third-Party Services

The Service relies on and links to third-party services and websites (including court portals, messaging providers such as Meta/WhatsApp, and payment processors such as Razorpay). We do not control and are not responsible for their content, availability, policies, or practices. Your use of those services is governed by their own terms.

13. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted or error-free operation. We do not warrant that the Service, or any alert, will meet your requirements or be available at any particular time.

14. Limitation of Liability

To the maximum extent permitted by law, we (and our owners, employees, and partners) shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, data, goodwill, opportunity, or for missed hearings, deadlines or limitation periods, arising out of or relating to your use of (or inability to use) the Service.

To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service shall not exceed the total fees you paid to us in the three (3) months immediately preceding the event giving rise to the claim, or INR 1,000, whichever is lower.

15. Indemnity

You agree to indemnify, defend and hold harmless CaseKhabar and its owners, employees and partners from and against any claims, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your content, your breach of these Terms, or your violation of any law or third-party right.

16. Suspension and Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law, or to protect the Service or other users. You may stop using the Service and request deletion of your account at any time by contacting us. Certain provisions (including disclaimers, limitation of liability, indemnity, and governing law) survive termination.

17. Changes to these Terms

We may update these Terms from time to time. We will update the "last updated" date and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Subject to applicable law, the courts at Prayagraj (Allahabad), Uttar Pradesh, India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
